Last week was my court date for what would be the 3rd speeding ticket on my record. I had told my attorney that I understand if I have to pay a fine but I need it off my record and that if it was going on my record, I wanted to put up as big a fight and inconvenience for the cop and DA as I could.

My attorney was out for drinks and ran into a friend from the DA's office. When they were done, he paid his tab. A few weeks later he called the guy (not the same one handling my case) and said he needed a favor and to see if he could talk to the prosecutor handling my case. Turns out they filed it as "Refuse to Prosecute" for lack of evidence. No fine, no court costs, no record and my attorney didn't even charge me (although I'm buying some dinner gift certificates for he and his wife, they are sort of friends of mine through work). So now if I can keep clean till September, another ticket drops off my record and then in May 2004 I'll be clean and ready to drop the lead foot again

hell yea, that is what I am talking about....way to stand up for yourself and get off the ticket. If I remember correctly you were not speeding were you?

He said I was 50 in a 35. I am POSITIVE I was not going 50, but I was going over 35, probably about 42. I was just talking to my son on the way to Boy Scouts, not like I was in a hurry to my meeting of the Amreican Branch of Saddam Fedayeen. Cop also claimd I made a left turn on a light that turned red and my son and I are are positive that it was green and if it had been red, the cop would have had to run a red light to follow us, which I think is why he decided not to write up the red light part.

haha i have a bullshit ticket coming up on the 18th that i gotta take care of...mayb i should just say guilty so i can take advantage of traffic school and get it off my record...oh ya and my ticket was a bs 51 in a 35...and on top of that i had cars all around me so he couldnt have hit my car with his damn laser gun. but next time im definitely gonna do what you did...inconvenience them as much as possible...wont go down without a fight :angry:

Just remember to do whats in your best interest. As much as I was pissed at the cop, I told my attorney I would be satisfied if I just paid the fine and kept it off my record. But if the DA wouldn't cut a deal, to let the DA know that the client (me) is really upset at this...going to Scouts..upstanding citizen with a job..bla bla and that I knew of specific instances where this same cop had given BS tickets. (My wifes boss is an OBGYN. Same cop ticket him 35 in a 25 right next to the hospital while he was going to deliver a baby. The doc asked the cop to come into the hospital with him and verify but the cop held him in th parking lot 15 minutes while the patient was in labor) But I wanted to let the DA know that they would have to WORK for this one and it just isn't worth the effort to the DA to put a lot of effort into traffic citations.

I got a 60 in a 35 zone for 50 in a 40... which pissed the hell out of me. He also pulled me over at 11:50, waited until 12:05 to write the ticket and then wrote me up for driving out of my provisional time (before 1st year with license you can't drive between 12-5am). ghead
...What an asshole.
But on the other hand, I have also been caught for 75 on a 25 (down bayshore, a road that runs right next to 101 with all the cars whizzing by).. I just had never driven on that road before and didn't know the limit was so low... it didn't seem like the type of road to.. oh well, no more excuses. the cop let me off.
So I guess I can't complain, eh? I didn't speed at ALL for another few months after that... just to honor the cop. Thank you, whoever you are. And the other cop... fuck you.
