Ok so heres what went down. Im in the school parking lot, and I see my friend coming towards me (we're going opposite directions). He pulls left into a spot, all the way in mind you, and i pass him. I turn to the right, but stop behind a parked car, so that i have room to back up into a spot. Well since I wasnt pulling stright back, I was forced to go a little wide and was looking over my left sholder so I knew how far from the car next to me I was. My friend, who deicided to back up into the spot next to where i was going, did so. Since i had to swing wide a little our back-ends hit (it wasnt an excessive amout of swining, i was going to make it into the spot perfect).
Well hes trying to blame it on me, and there are other witnesses that say it was my fault (obviously the didnt see all that happened). My defense is: he pulled into to first spot, and stopped completely, how the hell I was supposed to know he was backing into the other spot? Since he pulled in he looses all right of way and its his job to watch out for me. I obviously have some resposibilty and should be watching for him, I was looking over my other shoulder though, not like i was backing in blind folded. Since he is conviced it was my fault hes insisting I pay for his and mine. I know it was his fault, but feel guilty making him pay for my car car becuase his family is tight on cash, even through insurance. Although it is my baby....
So thats what happned.

Im trying to get him to split it 50/50 becuase it was his fault, but i still feel bad raping him for repair money. If he doesnt do that, then Ill just be a dick and go to insurance, I mean it is my baby.

IMO, its kinda both your faults cause in a parking lot no one really has "the right of way". I always use my mirrors to back up so I can see if people are doing stupid ass things in front of me too.
My wife had a smiliar incident in a Sam's club parking lot. She was pulling out of a spot and a car, directly across and behind her pulled out 3 seconds before she did so he hit her just in front of the rear wheel on the driver's side.
Obviously his fault for not paying attention. However in parking lots, the police are kinda funny.
We let the insurance companies fight it out. Eventually, it went through subrogation and the other insurance company paid half. We even got a check for $250, half the deductable!!

ya, but how long did it take for you to get your money from the insurance. My friend had some girl crash into his car and total it Even after the police filed the report saying it was the girls fault, he still has not seen any money. This was over a month ago. LAME
Insurance is sometimes not even worth going through. Get an estimate first and see if it will be worth the hassle. It will probably be a lot though since that is a hard spot to fix. Good luck with everything.
Yeah usually with parking lots they will assign a fault percentage, like it was 70% your fault for pulling into one spot and then backing up into another one, and it was 30% your fault for not checking behind you or something to that effect.
If it is a minor amount of damage I would just do 50/50 and not bring the insurance into it - you will pay much more than the cost of your car in increased rates!
I've been in three accidents - none my fault the other person always got a ticket from the cops - and my insurance is through the roof.
Avoid even mentioning anything to your insurance company. Only involve police if you have no idea who the person is. If the guy's an ass, go with insurance. If he's personable, try to settle it outside of insurance. Insurance is a last resort in almost all cases, it'll cost both of you more in the long run.
