here is a thread from the m3forum. apparently the National Highway Traffic Safety Administration will be banning the sale of aftermarket HID kits as of 8/15/03.

the ban is ONLY for the actual HID, you can still get ellipsoid/projector beam housings (like ZKW, inpro, etc), just the HID source (bulbs & ballasts) are affected. affects aftermarket only, not OE. note that it has always been illegal to use non-OE HID on public roads, but it was difficult for the NHTSA to enforce, so they are resorting to banning the sale of such items.
whether or not it is a hoax, vendors are taking it seriously enough to liquidate their remaining inventory. either way, as they have all dropped their prices, now may be a good time to get an HID kit if you've been thinking about it
