E60 2007 Transmission problems

My E60 2007 530i at only 50,000 miles started to develop the following automatic transmission malfunction. When driving at sport mode at a constant speed, the transmission keeps downshifting and upshifting while my foot is steady on the gas pedal. Also when driving it in manual mode using the steptronic facility, the gearbox holds first, second and third gears till the redline or when i shift it manually . However, when shifting to 4th gear, it doesnt keep holding the gear anymore and shifts immediately up to the 5th and then to the 6th gear automatically without any control from me although the car is still in manual mode ! When driving at normal mode, everything is fine and none of these problems exist !

The dealer says the normal procedure for this case is to completely drain the transmission oil, refill with new oil and recalibrate the gearbox. However, they say, they dont guarantee the result.

Has anyone faced this problem ? Any comments would be highly appreciated.

I would definitley drain the ATF and get a new filter and see if that helps. When they say "recalibrate" do they mean their just going to reset the tranny computer?
