This is an extremely common problem on E39s. There are a number of things you can do, but the best would be to write BMWNA about the issue. There are currently a great number of people expressing their displeasure about this serious lack of quality control (some people's seats start creaking when the car is only a couple months old!). For fixes, check out www.540i6.com or www.bmwtips.com. I used the simple zip-tie fix and my creaking is almost completely gone.
