Posted before about "transit mode" - car was left in transport mode from factory. Have been told mode is to prevent dock workers from racing BMW's. I've been complaining about performance since new, have almost blown clutch because of it. Now they say it wouldn't have hurt car, just had timing retarded. Mileage on 2003 325xi has gone from 26 MPG, to 23 since they "fixed" it, would retarded timing have that result? Are there any BMW experts to consult about consequences of this to my car? Once fixed, dealer now claims it wasn't in transport mode and that they only changed fuel filter. Is a lawsuit the only solution to he said - they said??..... any help appreciated.

no real damage. maybe some consequences to the cat (shorter life span), but no engine damage. if it works ok now i'd chill.
