Central locking sticking on drivers side

I have a 2002 325ti. When I unlock my car using the button on the key the drivers side lock doesn't always pop up. I have to re-lock then unlock before it works. The passenger side is fine, its just the drivers door. This usually happens in the morning or after leaving the car for several hours. If I unlock by putting the key into the lock it works ok, just when using the remote locking.
Apparently the key gets charged up while in the ignition, would this be something to do with the rechargeable battery in the key?

Has anyone else had a similar problem, if so please let me know?

This is not likely the key battery, as it would be an all-or-none event. As I understand it, there are different mechanical parts used for remote unlock which are bypassed by using the key in the door.
