which is a better deal

I am looking at two very similar cars, and wanted people's opinions. They're both 328i convertibles, both with premium package, cold weather package, both with 9000 miles. One comes from carmax and is blue with tan leather interior with navigation, 2008. The second comes from a dealer in NJ and is CPO, 2009, with an upgraded sound system, satellite radio, and the sport package. Carmax wants $38,000. The dealers is asking $44,000 but says they'll sell it for $43,000. What do you think?

Also, the 2009 is black on black

sports package is sweat, but I wouldn't want to drive a black on black vert - too hot in summer weather. I'd opt for the blue one.

If all else is the same I'd go for the cheaper one. Other then that it would be up to you to get what you want.
