Im sure someone here has, I've done tons of research on this matter. Here is what I've found
1. Your gonna get about 3hp peak increase
2. You will notice an improvement after 4500rpm where the OBDII E36s quickly loss power
3. The rev limit is removed which is handy
4. Top speed limiter removed, I guess this is good if you like to drive your BMW faster then 128mph.
5. The shark is optimized for use with an aftermarket CAI. They quote a 30hp increase @ 6500 RPM when coupled with CAI. (keep in mind this doesnt mean you getting 220hp @6500 because of the HP/Torque curve.
6. I've read articles that quote Dinan installers saying that the shark is offers more gain over the Dinan counterpart.

Conclusion:

I quickly learned that with the OBDII cars the LAST modification you make is software......... here's why.

spend another $50 and get custom tuned AA software just for your car & mods. They will optimize programming based on the modifications you've made to your car, this is especially useful for M50 manifold & HFM conversions. Note: This requires you to remove your ECU from your car and send to AA in FL, so you will be without a car for a 3 or 4 days.

there are a few on the forums that have it.. one of them will see it soon patients. anyways you lose your car for 3-4 days? i dont think that is right... maybe though

i thought you prety much plugged it in let it do its thing and you are good to go

The Active Autowerkes custom programming requires that you remove the ECU from you car and send it to them. Assuming you overnight to them (1day) then reprogram the day they receive and send back (3day UPS.)

AA quoted.
$399 for custom software for intake, exhaust and M50 mani. (which includes the rev limit & speed governer)
$499 for all of the above and HFM adjustments
$??? all of the above and M3 cams

add another $125 and they will socket your ECU so whenever you request modifications to your software they will send a replacement chip that you just slap in.

The shark is $349 and only tuned for intake (not sure about exhaust)

I also read an interesting article about a 328 that with the usual mods (intake, exhaust, m50, and the custom software put the rwhp @ 200-205 which is about that of an M3. (don't quote me on this, the story was and dyno chart was on the eurospeed.com website and I can't find it right now)

I don't have the AA software, nor do I know anyone personally that has done it, just what I've read over and over again, so take all of this with a grain of salt.

The Conforti Shark Injector is a great buy.. its sold mainly by TMS.. but its made by Conforti...

It does not remove the rev limiter.. just moves it a little higher too...

It alters a few other things other than what you have said too...

Go to the TMS site.. and read some...

I also have this upgrade.. I think its a good one.. and has done good things.... well worth it in my opinion...

TO be honest, it's fairly worthless as far as power gains. I noticed virtually nothing. All you really buy it for is to highten the rev limiter and take off the governor.
