e36 transmission leak

when i bought my e36 i replaced the transmission pan gasket because it was leaking. i only did the larger pan didnt replace the filter or anything either. anyways, its still leaking (slowly) and im wondering if maybe the pan is warped ? it seems to be coming out of the seal...does any of this sound common ?? do you think i need a new pan, maybe didnt replace the gasket correctly or (hoping i dont have to do this) need to replace the pan as well as whatever part it bolts up to ?

i topped the fluid off today and its still slipping a bit...could it be the filter? im sort of at a loss here.. im thinking about just taking it to the dealer and getting it fixed for good, but im afraid of the costs. anyone have any idea what the problem could be ? acceleration is lacking a bit now and it seems like it revs higher than normal too. im hoping its just a clogged tranny filter or something, but still leaking a little too (even after i replaced the seal as previously stated) what $ can i expect to fork over if i have the dealer fix it?
