Does BMW sell/make clear tails

Bought a set from a guy on ebay (I know, I know), claimed they were BMW parts and he bought them at SF BMW delaership. BUt they are not very high quality and don't have any evidence of being BMW parts. They also arrived broken because he packed them together loosely in bubble wrap, and they could still bounce around loosely in the box.
He's offering me a $20 refund on $154.00, and claiming packing is not his responsibility ???
Avoid him. His ebay user name is euro_part_trader, and he's selling m3 and other used parts. He has 100% + feedback on 38 items, but that will change soon.

Are there BMW roundels and p/n stamped on them? If not, they are not OE.
