It is a good thing to have that. Below 2500rpm it stays closed. It increases backpressure thus increases low end power.

Increases low end torque because of the backpressure and keeps the noise down just a tiny bit when it's closed.
Nifty device, it's pneumatic and it's attatched to a little air pump.

Don't remove it, you wont gain anything. There was another thread like this almost a week ago on this very same topic.

was this a factory option? or does BMW sell this thing? I've heard of silencers coming on aftermarket exhausts, but not on factory exhaust....

From your sig I can see you have a 318..

318's (single pipe exhaust)do not have it. 325's (dual pipe muffler) have the valve.

So you shouldn't have it..

325's don't have it. I believe it started with the 328's.
M3's don't have it either.
